About

Andy has played a central role in some of New Zealand’s most novel and contentious regulatory proceedings.  He has particular expertise in financial markets law, credit finance, consumer law and regulatory enforcement.  He is an effective courtroom advocate with experience arguing cases before juries, first-instance decision-makers and appellate courts.

Andy’s work also includes contentious commercial matters, with a particular focus on shareholder proceedings, competitor Fair Trading claims, and banking and finance litigation.

In addition to his litigation practice, Andy works closely with regulatory agencies to progress difficult investigations in ways that are proportionate, effective, and tailored to the regulator’s enforcement objectives.  He is known for his practical and timely advice, and his innovative and incisive approach to navigating complex legal challenges.

Financial services

Acting for the Financial Markets Authority in proceedings against a major fund manager alleging breaches of Part 4 of the Financial Markets Conduct Act (Financial Markets Authority v Booster Investment Management Ltd & Ors [2026] NZHC 258; [2025] NZHC 1526).

Acting for the Crown in proceedings alleging criminal insider conduct (R v Huljich [2025] NZSC 99; [2025] NZCA 155; [2023] NZHC 3332); and for the FMA in follow-on proceedings ([2026] NZHC 2313).

Acting for the FMA in a number of pecuniary penalty proceedings against banks and insurers (including Westpac [2025] NZHC 1027; Kiwibank [2023] NZHC 2856; and ANZ [2021] NZHC 399).

 

Credit and consumer protection matters

Acting for the Commerce Commission in significant consumer credit litigation (including Co-operative Bank [2026] NZHC 815; Westpac [2025] NZHC 3640; Kiwibank [2024] NZDC 28692; TSB [2024] NZHC 2400; and Harmoney [2020] NZCA 275).

Acting for the Commerce Commission in contentious matters under the Fair Trading Act 1986, including recent proceedings against Viagogo GmbH ([2024] NZHC 713).

 

Selected commercial matters

Successfully defending injunction proceedings alleging passing off and Fair Trading breaches, including the ‘Whānau Ora’ litigation.

Acting on contentious proceedings involving ownership of cryptocurrencies (Westpac New Zealand Ltd v Renner & Ors [2024] NZHC 3628).
