Gareth jointly leads the Insolvency, Recoveries and Enforcement Group with fellow Partner Nick Malarao. He assists clients on a broad range of litigation and insolvency matters. Gareth has primary responsibility for the day-to-day management of matters on behalf of the Official Assignee, and also acts for private top-end liquidators.
He is proficient in all aspects of personal and corporate insolvency and is often engaged in complex high-end High Court and Court of Appeal insolvency-related litigation.
- Successfully defended appeals brought against decisions of the Official Assignee (Miah v Official Assignee).
- Acted in the appointment of a receiver to a trust pursuant to the inherent equitable jurisdiction of the High Court (Official Assignee v Smith).
- Acted in a leading Court of Appeal case in relation to voidable transactions and breach of directors' duties (Levin v Ikiua).
- Acted in a leading Court of Appeal case on s 37 of the Securities Act 1978 (Chean v De Alwis).
